What is a title dispute?

A title dispute is a disagreement over who has legal rights to a piece of property. In Virginia, all real estate disputes are handled by the courts. When a title dispute arises, it means that two or more parties are claiming ownership of a particular piece of property or land. A title dispute could involve a disagreement between neighbors over a boundary line or a disagreement over who inherited a property after the death of the owner. In most cases, this involves looking at the deed to the property, along with other relevant legal documents. If the title is disputed, the court will look at property records, transfer documents, and other evidence to determine which party has the best claim to the property. If the court finds that one of the parties has the legal right to the property, the court will enter a judgment in favor of that party. The court may also award damages or order the other party to pay legal fees. If a settlement between the parties cannot be reached, the court may order a trial to decide the rightful owner. In either case, the court will ultimately determine who the legal owner of the property is.
