What is the law concerning the development and use of unmanned aerial vehicles (UAVs)?
In New York, the use of unmanned aerial vehicles (UAVs), also known as drones, is regulated by a set of statutes and regulations. Under the law, a person using a drone must obtain a license from the New York State Department of Transportation. The license is granted for specific purposes, which must be stated in the application for the license. A pilot must also possess a valid pilot’s license or student pilot’s license in order to apply for a license. The law also requires that any UAV must be operated in a manner which does not create a hazard to people or property, that it is flown only in airspace where it is permitted under federal law, and that it is not flown within five miles of an airport or heliport. Additionally, UAVs must not be flown at altitudes greater than 400 feet above ground level, except where necessary for navigation purposes. UAVs also need to be registered with the Federal Aviation Administration. This registration is separate from the license issued by the New York Department of Transportation. Finally, any use of UAVs for commercial purposes is prohibited in New York, unless otherwise stated in the license issued by the Department of Transportation.
