What is a Uniform Dispute Resolution Policy (UDRP) claim?
A Uniform Dispute Resolution Policy (UDRP) claim is a type of legal action available to North Carolina businesses who believe they have been victims of unfair or deceptive competition by another business. It is a mechanism which allows businesses to resolve disputes in a fair and equitable manner without having to go to court. Under the UDRP, if a business believes another company is engaging in unfair competition, it can file a claim with an independent and impartial dispute resolution body such as the National Arbitration Forum. The Forum is then responsible for assessing and deciding the claim in a fair manner. To determine if the competition is unfair, the Forum will look at the facts of the case and consider the applicable laws of North Carolina. For example, the Forum will consider whether the competition is false or misleading, involves unlawful or misleading advertising, or is part of a pattern of unlawful behavior. The Forum will then make a decision as to whether or not the competition is unfair and may award damages, order the offending company to stop the unfair practice, or both. It is important to note that UDRP claims are often cheaper and quicker than going to court and the decisions of the dispute resolution body cannot be appealed.
