What provisions does the FLSA provide for overtime pay?

The Fair Labor Standards Act (FLSA) is a federal law that defines minimum wage, overtime pay, and other labor standards for employers and employees in the United States. In Nevada, the federal minimum wage is $7.25 per hour, and employers must pay employees one and a half times their regular rate of pay for hours worked in excess of 40 hours per week. The FLSA requires that nonexempt employees, or those who are not exempt from the overtime rules, receive 1.5 times their regular rate of pay for any hours worked over 40 in a workweek. In Nevada, employers are not allowed to make deductions from an employee’s wages for overtime hours unless the employee forfeits hours of compensatory time off. This means that if an employee works more than 40 hours in a workweek, the employer must pay the employee time and a half for those hours worked. The FLSA also provides additional guidance on how to calculate overtime pay for certain types of employees. For instance, employers must combine the hours of multiple employees who regularly work in the same establishment when determining overtime eligibility for salaried employees, such as those who are paid a flat salary for all hours worked. In addition, employers must pay overtime to employees who work multiple jobs for the same employer during the same workweek. Lastly, certain types of employees, such as those in executive, administrative, and professional positions, are typically exempt from overtime pay requirements. If an employer classifies an employee as exempt, they are not subject to the overtime pay provisions of the FLSA.
