What is a sealed claim?
A sealed claim is a type of legal claim made by a whistleblower in the state of Washington. In some cases, the elements of a whistleblower case are so sensitive that the accused could potentially use the information the Whistleblower has exposed to negatively affect the whistleblower. To protect the whistleblower’s rights, the law allows the claim documentation to be sealed. When a claim is sealed, it is not made available to the public. It is only accessible by the court, the complainant, and other parties involved in the case. A sealed claim safeguards the confidential information of the whistleblower, including facts surrounding the case, evidence gathered, and any other relevant information. The court can also decide to limit which parties can view certain sections of the claim, or even issue a protective order to keep certain elements of the case confidential. This helps to ensure that the whistleblower’s identity and important case information remain confidential and out of the public domain. In Washington state, sealed claims are protected by the Whistleblower Protection Act, which ensures that whistleblowers can report misconduct and illegal activities without fear of retribution. The law also provides certain rewards to whistleblowers, such as a portion of any fines or settlement proceeds, which can be used to cover any legal expenses or damages. This law is designed to encourage the public to come forward and report wrongdoing without fear of repercussions.
