What is a retaliation claim?
A retaliation claim is a legal action an employee can take when they believe they have faced repercussions or mistreatment for whistleblowing. In Mississippi, such claims are protected under anti-retaliation laws designed to protect those who come forward with information or complaints regarding illegal activity. Retaliation claims are also commonly referred to as ‘whistleblower suits’. These are filed by an employee who has been discriminated against, disciplined, or even fired for speaking out and reporting illegal activities. This could be anything from health and safety violations to fraudulent or unethical business practices. If an individual is found to have experienced workplace retaliation, they may be eligible for damages that include back pay, lost wages, and emotional distress. In addition, the employer can be required to reinstate the employee or provide other reasonable and equitable remedies to make the employee whole. Retaliation claims can also be made if an employee experiences negative treatment because they are associated with someone who has reported illegal activities to the authorities. This includes family members, friends, or co-workers of the whistleblower. In such cases, employers may be required to provide relief in the form of reinstatement and back pay.
