What is a disability rating?

A disability rating is a determination made by the Virginia Workers’ Compensation Commission that assigns a percentage to a worker’s total disability. This percentage is based on the worker’s ability to return to their job before the injury occurred. A disability rating is usually determined by a doctor and is used to determine the amount of compensation that the worker may receive. The Virginia Workers’ Compensation Commission bases its disability rating on two factors: the worker’s physical impairment and the worker’s ability to still perform the same job. Depending on the worker’s physical impairment, the Commission may assign a worker a specific percentage of their maximum earning capacity before the injury. This percentage determines the amount of compensation that the worker may receive. The Virginia Workers’ Compensation Commission also allows for partial disability ratings. This means that if a worker can still perform the same job, but at a reduced capacity, the Commission may assign a lower percentage of the worker’s maximum earning capacity. This ensures that workers are receiving a fair amount of compensation for the work that they are able to do. It is important to keep in mind that each disability rating is specific to the individual’s case and could change depending on the situation. Disability ratings are meant to give workers a fair amount of compensation depending on their ability to return to their pre-injury job. It is important to thoroughly discuss any disability rating that is assigned to you with your doctor and lawyer.
