What is a workers' compensation lien?

A workers’ compensation lien is a legal claim on a person’s assets that must be paid to a workers’ compensation provider in the state of Washington. It is a form of financial security for a workers’ compensation provider should their claim or requests for payment be denied or not met. In the state of Washington, workers’ compensation is a form of insurance that employers are required to provide to their employees in the event of a work-related injury or illness. The lien ensures that if employers fail to pay their workers’ compensation premiums, the workers’ compensation provider can still cover the employee’s claim. The workers’ compensation lien must be acknowledged by an employer in writing as a legal lien on their assets. The lien may also be acknowledged by an employee if they are accepting workers’ compensation payments. In Washington, workers’ compensation liens will remain on a person’s asset for up to six years, however, this is subject to expiration or reconsideration depending on the circumstances of the case. The purpose of the lien is to protect workers’ compensation providers from taking losses in the event of an employer or employee not paying the premiums. It is a form of assurance that their claims will be honored and their payments will be received. This is especially important in the state of Washington, where workers’ compensation bills are often high due to the prevalence of workplace injuries and illnesses.
