What are the different types of wrongful termination?
Wrongful termination is when an employer terminates an employee’s employment unlawfully. In North Carolina, it is illegal to terminate an employee for a reason that goes against the state or federal laws. The most common types of wrongful termination include: 1. Discriminatory Termination – This is when an employer terminates an employee because of their race, religion, gender, age, or other legally protected class. 2. Retaliatory Termination – This occurs when an employee is let go after filing a complaint against an employer for any sort of workplace discrimination or harassment. 3. Constructive Termination – This happens when an employer makes changes to the employee’s work environment that make it so hostile or unbearable that the employee is forced to quit the job. 4. Breach of Contract Termination – This occurs when an employer fails to abide by the terms of an employment contract, resulting in the employee’s termination. 5. Fraudulent Termination – This occurs when an employer lies or misleads an employee in order to terminate them. All of these types of terminations are illegal in North Carolina and can result in serious consequences for the employer. It is important that employers know and understand the laws that protect their employees so that they do not engage in any wrongful terminations.
