What kinds of cases are eligible for wrongful termination lawsuits?
In North Carolina, several types of cases can be eligible for wrongful termination lawsuits. This includes circumstances where an employee was terminated due to a discriminatory reason, such as their sex, age, race, national origin, or disability. It also includes cases where an employee was fired for blowing the whistle on unethical or illegal activity, or in direct retaliation for reporting something to the authorities. Additionally, wrongful termination may occur when an employer terminates an employee in violation of an employment contract such as an at-will agreement, or to prevent the employee from exercising a workplace right such as taking leave. Wrongful termination can also occur when an employer uses false accusations or other false information as a reason to fire an employee. Furthermore, wrongful termination can occur when an employer fires an employee in violation of public policy, such as firing someone for serving on jury duty or for taking time off under the Family Medical Leave Act (FMLA). Lastly, an employee may have a claim for wrongful termination if they were terminated for refusing to perform illegal acts required by the employer.
