What is the Packers and Stockyards Act?
The Packers and Stockyards Act (PSA) is a federal law administered by the United States Department of Agriculture (USDA) that regulates the commercial transactions between and among livestock, poultry, and meat packers, producers, dealers, stockyards, and other related industries. The PSA was enacted in 1921 to ensure fair and competitive trade practices in the agriculture market and to protect producers and consumers in the industry from unlawful, anti-competitive behavior. The PSA protects producers from deceptive or discriminatory practices such as deceptive weighing or grading of animals, manipulation of prices, or other deceptive practices that can disadvantage producers and buyers. The PSA also requires the U.S. Secretary of Agriculture to investigate and report violations of the Act. The PSA also provides broad authority to the USDA to enter into agreements with producers and sellers and to take action against persons who violate its provisions. The PSA also sets standards for business practices in the industry, such as advertising and accounting. In California, the state inspectorate ensures that the provisions of the PSA are enforced. The State has adopted several statutes that supplement the PSA provisions, such as the Livestock and Poultry Regulation Act, the Poultry and Egg Regulation Act, and the Meat and Poultry Inspection Act. These state and federal laws work together to ensure that fair business practices are followed in the agricultural industry and that consumers receive a safe and healthy product.
