How are aircraft accidents investigated and what are the legal actions that can be taken?
Aircraft accidents are investigated in Washington by the National Transportation Safety Board (NTSB). The NTSB is responsible for investigating the cause of an aircraft accident and determining what led to the crash. The NTSB gathers evidence, such as the aircraft maintenance records, pilot logs, weather reports, and any other pertinent information. After gathering the evidence, the NTSB will generate a report that details their findings on the cause of the accident. Based on the NTSB’s findings, legal action may be taken. Depending on the cause of the accident, the FAA (Federal Aviation Administration) may issue an enforcement action, such as a fine or suspension of the pilot’s license. If criminal negligence is found to have been a factor in the accident, criminal charges may be filed against any persons responsible. In cases where one or more parties are determined to be at fault, a civil lawsuit may also be filed. In cases where pilot negligence is found to have contributed to the accident, the FAA may require pilots to attend additional training or take additional tests in order to maintain their certificate. In some cases, the FAA may revoke a pilot’s license if the investigation reveals that their actions were egregious. No matter the outcome from an aircraft accident investigation, families of the victims may be entitled to compensation from the responsible parties. In cases of pilot negligence, the FAA may require the pilot to make restitution to the victim’s families. However, if the incident was determined to be beyond the pilot’s control, legal action may be sought against manufacturers of the aircraft or components, or any other responsible parties.
