What is the international law concerning aviation accidents?
The international law governing aviation accidents is derived from a treaty known as the "Convention on International Civil Aviation." This treaty, also known as the "Chicago Convention," was signed in 1944 and is administered by the International Civil Aviation Organization (ICAO). Under the Convention, the ICAO sets the international standards and recommended practices (SARPs) for aircraft and air navigation, as well as the rules governing the investigation of aviation accidents and incidents. In the event of an aviation accident or incident, the Convention requires that the investigation be conducted independently and impartially. The investigation should include an analysis of all available evidence and should be conducted in a manner that will ensure the safety of future flight operations. It is the responsibility of the State in which the accident or incident occurred to conduct the investigation and to make available to the ICAO the results of the investigation. In addition to the investigation, the Convention also requires that States take necessary measures to prevent aviation accidents and incidents, including enacting safety regulations for the operation of aircraft and air navigation services, providing training and qualifications for personnel, and establishing a system of airworthiness certification. Finally, the Convention encourages cooperation and coordination among States to facilitate the safe and rapid movement of air traffic.
