What are the laws governing product warranties?
In Washington, product warranties are covered by the state’s “Uniform Commercial Code”. This code states that any product sold must come with a warranty that states the minimum amount of time the product will be covered for and the amount of coverage the warranty will provide. If the warranty does not specify a certain amount of time or amount of coverage, it is considered an implied warranty. Implied warranties are common for items like appliances, cars, and electronics, and they guarantee the product will be fit for its intended purpose. Additionally, any product sold must have a statement on the packaging that states the warranty is only valid for the full purchase price. The law also states that any product sold with a warranty must be repaired, replaced, or refunded if it does not meet the terms of the warranty. If the product is damaged or missing parts, the store must give the consumer a full refund or a replacement product. Additionally, if a product fails to meet the warranty stated on the packaging, the seller must repair or replace the product or provide a refund. If a company has a policy that states that it will not provide any type of warranty, this policy must be clearly communicated to the consumer. Additionally, the consumer must be informed that the policy will supersede any implied warranties that may be included with the product.
