Are there consumer protections against price-gouging during emergencies?

In Washington, there is a law that prohibits price gouging during emergency situations. Price gouging is any practice that artificially increases prices, often in the event of a natural disaster, illness outbreak, or other emergency. Price gouging can take the form of drastically increasing prices on essential goods, including food, clothing, emergency supplies, or medical supplies. Under Washington’s Consumer Protection Act, businesses are prohibited from charging an excessive price for essential goods during an emergency. The Office of the Attorney General must determine whether or not a particular price is excessive. Generally, an excessive price is considered to be one that is more than 10 percent higher than the regular customer price. If a business is found to be price gouging, the Attorney General can seek a court order to stop the practice and obtain restitution for consumers. Businesses found guilty of price gouging can be fined up to $2,000 for each violation. Consumers may also have the right to take legal action against a business that has engaged in price gouging. It is important for consumers to be aware of the potential for price gouging during emergency situations and to contact their local authorities if they believe they have been a victim of price gouging. While price gouging can be difficult to identify and stop, the Consumer Protection Act provides Washington residents with a measure of protection against unscrupulous businesses during times of emergency.
