What is a civil union?

A civil union is a legally recognized form of relationship between two individuals in California. It is similar to — but not the same as — marriage. An individual in California may enter into a civil union with another individual regardless of their gender or sexual orientation. Civil unions provide couples with many of the same benefits and protections as marriage. Partners in a civil union have the right to make medical decisions for their spouse in emergencies, as well as the right to inherit each other’s assets. In addition, partners in a civil union in California are entitled to the same tax benefits, health insurance benefits, and Social Security benefits as married couples. Couples who wish to form a civil union must visit a county clerk’s office and fill out an application. Both individuals must present valid proof of identification, such as a driver’s license or passport, and proof of residence. The couple must also sign a civil union document in front of a notary public. The couple will then be issued a civil union certificate, which legally establishes their union. Civil unions can be dissolved like marriages. Couples must file a petition for dissolution with the court, and must pay a filing fee. After the dissolution is granted, the partners are no longer bound by the laws governing civil unions.
