What are the rights of students in public schools?
Students in public schools in California are guaranteed certain civil rights by the state and federal law. These rights ensure that all students are treated fairly, regardless of their race, national origin, gender, disability, or any other legally protected class. To begin with, public schools must not engage in any form of discrimination. This means that the schools must treat each student equally and must provide access to educational resources and opportunities that are the same for everyone. Additionally, students can expect to be provided with a safe learning environment that is free from intimidation or harassment and where everyone is treated with respect. Public schools also must respect students’ rights to privacy and to free speech. This includes allowing students to express their opinions and beliefs in a nonviolent manner as long as it does not interfere with the educational process. Similarly, the schools must maintain the confidentiality of student information. In addition, public schools cannot deny students access to educational materials or activities based on their religious beliefs, and schools must provide reasonable accommodations for students with disabilities. Schools must also address situations of bullying or hazing in a timely and appropriate manner. Finally, all students have the right to be informed about their educational rights and to have access to educational resources, such as books and Internet access, in order to advance their education. Students should also be aware of their right to appeal any decisions made by the school that they feel are unjust.
