When does the Fair Debt Collection Practices Act apply?

The Fair Debt Collection Practices Act (FDCPA) applies to companies that are in the business of collecting debt from individuals. It does not apply to original creditors (the companies you owe money to) or to government entities collecting debts. In Mississippi, the FDCPA applies to debt collectors who are attempting to collect debts from Mississippi consumers. This means that debt collectors must follow the FDCPA while attempting to collect a debt from a Mississippi resident. They must provide written validation of the debt in order to collect on the debt legally. The FDCPA also sets out guidelines regarding the manner in which a debt can be collected. Debt collectors cannot use oppressive or abusive tactics to collect debts. They must treat consumers fairly and in a manner that is not intended to harass, oppress, or abuse them. Debt collectors must also respect consumers’ rights with respect to how they communicate with them. They must adhere to certain consumer privacy protections and cannot disclose the debt to other parties without the consumer’s permission or court order. In general, debt collectors must treat consumers fairly and respect their rights while attempting to collect debts. If they fail to do so, the consumer may be able to file a complaint against the collector. The FDCPA provides consumers with a remedy for violations of the act.
