Can a debt collector threaten to sue me if I don’t pay my debt?

No, debt collectors can not threaten to sue you if you do not pay your debt in the state of Mississippi. According to the Fair Debt Collection Practices Act (FDCPA), it is illegal for collectors to use threatening or intimidating language when contacting debtors. Moreover, they are not allowed to falsely imply that legal action will be taken against a debtor if they do not pay. In Mississippi, debt collectors can explain the consequences of failing to pay back a debt. However, they cannot falsely threaten to take legal action if the debt is not paid. If a debt collector is attempting to collect on a debt, they can bring a lawsuit against the debtor in order to collect the money owed or to obtain a judgment. However, they are not allowed to threaten to do so as a way to intimidate the debtor into paying. If a collector contacts you and uses language that is threatening or intimidating, you are within your rights to contact the local office of the Consumer Financial Protection Bureau. Although debt collectors in Mississippi can still pursue payment of a debt, threatening to sue a debtor is not allowed.
