What is an interactive process?

An interactive process is a series of meetings between an employee with a disability and their employer to discuss reasonable accommodations for the employee’s needs. This process is covered under California disability law, which requires employers to engage in an interactive process with any employee requesting reasonable accommodation for their disability. This process is a typical part of the employer’s role in accommodating a disabled employee’s needs, and can include conducting an individualized assessment of the employee’s situation. During the interactive process, the employer and employee exchange information regarding the employee’s disability, the nature of the job tasks the employee is unable to perform because of their disability, and potential solutions or accommodations that could be made to allow the employee to perform their job duties. The employer and employee then work together to negotiate a satisfactory resolution or accommodation that works for both parties. The interactive process may also involve the employer consulting with medical professionals or disability specialists to help identify what kind of accommodation is possible. It is important to note that the goal of the interactive process is to work together collaboratively, with both parties coming to the table in good faith, to resolve the issue. If an agreement cannot be reached, employers may be obligated to take further action in certain cases depending on the circumstances.
