What is the reasonable accommodation process?
Reasonable accommodation is a process under disability law in Delaware that accommodations must be made to ensure equal access and fair treatment of individuals with disabilities. Reasonable accommodation means that employers, schools, and other businesses must make adjustments or modifications to their policies or practices that would allow individuals with disabilities to fully access their programs or services. The reasonable accommodation process begins when a person with a disability requests an accommodation from the employer, business, or school. The person requesting the accommodation must inform the employer, school, or business of the disability and why the accommodation is necessary. The employer, school, or business must then work with the individual to determine the type of reasonable accommodation that would be the most effective. This includes taking into consideration the individual’s disability, the individual’s needs, the tasks the individual needs to perform, and other factors. If the accommodation is reasonable and effective, the employer, school, or business must provide it. If the accommodation is not reasonable or not effective, the employer, school, or business can deny or modify the accommodation. However, the employer, school, or business must consider alternatives that could make the accommodation feasible. The reasonable accommodation process provides individuals with disabilities an opportunity to access programs and services that they would not otherwise be able to access. This helps to ensure that individuals with disabilities have equal access to the same opportunities available to those without disabilities.
