Are disabled people entitled to special consideration when applying for social security benefits?
Yes, disabled people are entitled to special consideration when applying for social security benefits in Delaware. According to the Delaware Social Security Administration, individuals who are disabled, blind or aged may qualify for disability benefits, with consideration for their individual circumstances. The Social Security Act of 1935 provides for a Disability Insurance program for individuals who have earned Social Security coverage through prior employment, and who are unable to work due to a severe medical condition expected to last at least 12 months or cause death. In order to receive disability benefits, individuals must meet certain criteria relating to their disability. For example, Delaware’s Social Security Administration may determine that an individual is disabled if they have one or more physical and/or mental medical conditions that greatly limit their ability to work and/or perform daily activities of living. In addition, individuals must have worked a certain amount of time in order to qualify for coverage. In addition to medical criteria, the Social Security Administration considers several other factors when determining an individual’s eligibility for Social Security disability benefits, including their age, education level, and any current work activity. Once an individual has met the criteria, they may be eligible to receive disability benefits until their health improves or until they reach retirement age.
