What is a durable power of attorney?

A durable power of attorney is a legal document that allows someone to appoint another person, known as an agent, to manage their financial affairs in the event that they become incapacitated, such as if they become disabled or in the event of death. In the State of California, several different types of durable power of attorney are available to individuals who want to make sure that their finances are taken care of in the event of a disability or death. A durable power of attorney for an adult allows the agent to make decisions about financial matters such as making payments, handling investments, and conducting banking transactions on behalf of the person giving the power of attorney. Similarly, a durable power of attorney for a minor is a legal document that allows a parent to authorize a trusted person to manage the financial affairs of their minor child in the event of their disability or death. A durable power of attorney for health care allows a person to designate someone else to make decisions about their healthcare if they are unable to do so themselves. This document can give the agent the power to make decisions about medical care, end-of-life care, and other issues related to health.
