What is a hostile work environment and is it illegal?
A hostile work environment is an environment in which an employee experiences unwanted or hostile behavior from their colleagues or superiors. This behavior may be physical, verbal, or psychological, leading to a harassing work environment. This behavior could be related to gender, race, ethnicity, nationality, disability, age, or other protected grounds. This behavior would be considered discriminatory and make it difficult for the employee to do their job. In Utah, it is illegal to make a hostile work environment. According to the Utah Antidiscrimination Act of 1965, it is unlawful to discriminate against any employee or potential employee in any employer’s place of business or during the course of their employment. This includes the right to be free from hostile or discriminatory conduct. This act protects both employees and job applicants from any form of discrimination. If an employee believes their workplace is creating a hostile work environment, they can file a discrimination complaint with the Utah Antidiscrimination and Labor Division (UALD). The complaint will be looked into and, if found valid, can lead to remedies for the affected employee. These remedies can include compensation for any damages and/or a change in behavior from the employer.
