Are employers allowed to ask about an applicant’s national origin during the hiring process?

In Utah, employers are not permitted to ask about an applicant’s national origin during the hiring process. This is because doing so would be considered a form of discrimination. According to the Utah Antidiscrimination and Labor Division, it is unlawful for employers to discriminate based on a person’s national origin when hiring, promoting, or terminating employees. This includes asking questions related to an applicant’s national origin, such as where they are from or what their native language is. Additionally, employers are not allowed to refuse to hire someone based on their national origin, nor can they treat employees differently because of their national origin. Employers who violate these laws can be subject to penalties from the Utah Antidiscrimination and Labor Division. The Division will investigate the complaint and take action if Employers are found to have violated the law.
