Are employers allowed to ask job applicants questions about their disability?

In North Carolina, employers are not allowed to ask job applicants questions about their disability when considering whether to hire them. This is according to the state’s Employment Discrimination Law. Employers may ask questions about an applicant’s ability to perform the job they are applying for, but may not inquire about the existence or severity of any disability. In addition, employers are prohibited from discriminating against any applicant or employee due to a disability, so they cannot take a disability into account when making hiring decisions.
