What is the Americans with Disabilities Act (ADA)?
The Americans with Disabilities Act (ADA) is a federal law in the United States that was enacted in 1990. It prohibits discrimination against people with disabilities in all areas of public life, such as employment, transportation, public accommodations, commercial facilities, and telecommunications. It also requires employers to provide reasonable accommodations for otherwise qualified individuals with disabilities in California. The ADA is designed to provide individuals with disabilities the same rights and opportunities to participate in everyday life as those without disabilities. This includes the right to seek employment opportunities and benefits, free from discrimination based on one’s disability. The ADA also requires employers in California to provide reasonable accommodations for qualified individuals who have disabilities. These reasonable accommodations may include allowing an employee to bring a service animal to the workplace, providing a flexible work schedule, or providing access to necessary equipment to perform a job. The ADA prohibits employers from engaging in unlawful discrimination on the basis of a disability and requires employers to make reasonable accommodation for qualifying individuals. The ADA also requires covered employers to make sure that the hiring process, performance and evaluation of employees, and termination process are all done in a manner that does not discriminate against individuals with disabilities. This means that employers must ensure that they treat disabled and non-disabled employees equally in all aspects of employment.
