What is the Americans with Disabilities Act (ADA)?
The Americans with Disabilities Act (ADA) is a federal law that protects individuals with disabilities from discrimination in employment, public access, and transportation. It was passed in 1990 and applies to all businesses with 15 or more employees in the United States, including those located in West Virginia. The ADA prohibits employers from discriminating against qualified individuals with disabilities on the basis of their disabilities in any of the following: hiring, firing, training, promotion, wages, benefits, and other terms, conditions, and privileges of employment. Employers must also reasonably accommodate the needs of employees with disabilities. Reasonable accommodations may include changes in job duties, changes to the physical workspace, or adjustments to work schedules. In addition to protecting the rights of individuals with disabilities, the ADA also requires that public places, such as restaurants, grocery stores, movie theaters, and hotels, be accessible to people with disabilities. This includes providing special features, such as wheelchair ramps, accessible restrooms, and elevators. The ADA also helps ensure that people with disabilities have access to transportation, including public buses, subways, and other public transportation services. The goal of the ADA is to promote equality and eliminate discrimination against individuals with disabilities in all aspects of life. Through the ADA, individuals with disabilities are able to access the same opportunities and resources as everyone else, regardless of their disability.
