What are the rights of temporary or part-time workers?

In California, temporary and part-time workers have the same rights as any other worker. This includes the right to safe working conditions, the right to receive minimum wage, the right to receive overtime pay, and the right to receive rest periods and meal breaks. Temporary and part-time workers are also entitled to receive workers’ compensation benefits if they suffer an injury or illness while on the job. These workers also have the right to join unions and to not be discriminated against based on their race, color, gender, religion, national origin, or any other protected class. Temporary and part-time workers are also entitled to receive unemployment benefits if they lose their job through no fault of their own. In California, employers are also required to provide written notice if wages have been withheld, and employers must pay out any wages and accrued vacation time in a timely manner when the employee is terminated. Lastly, temporary and part time workers in California have the right to file a claim with the California Division of Labor Standards Enforcement if they feel that their rights have been violated by their employer. The Division will investigate the employer’s practices and can order the employer to pay any wages that are due, as well as any applicable penalties.
