What is the International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families?

The International Convention on the Protection of the Rights of All Migrant Workers and Members of their Families is an international treaty that aims to protect the human rights of migrant workers and their families. This convention was adopted by the United Nations General Assembly in 1990 and entered into force in 2003. Under this convention, migrant workers and their families are afforded the same human rights and fundamental freedoms that all human beings should be entitled to, including the right to life, the right to freedom of movement, right to health and education, right to work, right to form and join trade unions, right to fair working conditions, freedom from exploitation and abuse, and freedom from discrimination. The convention also obligates states to take measures to protect and assist migrant workers and their families in their new countries of residence. These rights are also enshrined in California state law, with respect to guaranteeing certain rights to migrant workers and their families who may live and work in the state. These include ensuring fair wages, protection from exploitation, access to health care and other social services, and the right to form and join a union. California also prohibits discrimination against migrant workers and their families, ensuring that they can access the same rights and protections as non-migrant citizens.
