What is a no-fault claim?
A no-fault claim is a type of insurance claim that does not require any party involved to prove that the other was at fault for the accident or incident in order for a claim to be paid. In Washington, no-fault claims are based on the principle of personal injury protection (PIP). PIP covers medical expenses and other damages that can occur as a result of an accident, regardless of fault. Depending on the language of the policy, most PIP policies also cover lost wages and replacement services. In Washington, all insurers must provide a minimum of $10,000 PIP coverage. No-fault claims are designed to make the process of filing a claim less complicated and more efficient. In a no-fault system, the injured party is able to make their claim directly with their own insurance provider, without the need to determine which party was responsible for the incident. In some cases, a claim might be denied if it reaches a certain level of severity or if the cost of the claim exceeds the PIP coverage limit. No-fault claims are used in many states across the US, including Washington. It’s important to understand your no-fault rights and responsibilities as part of an insurance policy as it can help streamline and simplify the process of making a claim.
