What is the “asylum clock”?
The “asylum clock” is a timeline that begins on the day an asylum seeker enters the United States and requests asylum. This timeline is important as it helps determine the amount of time the asylum seeker has to submit their application and be approved. In Virginia, if you are an asylum seeker, you have 150 days to file a complete application and have it accepted by U.S. Citizenship and Immigration Services. This is the start of the asylum clock. Once that is approved, the asylum seeker has 180 days to apply to the asylum office in order to receive an asylum hearing. If the asylum office denies the request, the asylum clock is stopped and the seeker cannot reapply unless there has been a change in their circumstances. If the asylum seeker is approved by the asylum office, the asylum clock will restart and they will have 180 days to attend an asylum interview. Once the asylum interview is done, the asylum seeker is either approved or denied. If approved, the asylum seeker will have one year to submit an application for permanent residency. The “asylum clock” is an important timeline in Virginia and it is important to understand it as it can determine the fate of an asylum seeker. It is important to seek expert legal advice to ensure the asylum timeline is followed as any delays could result in the asylum application being denied.
