What is labor certification?

Labor certification is a process in the immigration law of Virginia which involves an employer submitting an application to the U.S. Department of Labor in order to hire a foreign worker. This process helps to ensure that the foreign worker will not have an adverse effect on the wages or working conditions of U.S. workers. The employer must demonstrate that there is a shortage of qualified and available U.S. workers who are able and willing to do the job, and must prove that the hiring of a foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. In order for the foreign worker to be certified for permanent residence, the employer must show that the position is of a permanent, long-term nature and is not subject to frequent changes in terms, conditions, or even wages. The employer must also show that the job offer is not one which is a form of job displacement as it relates to similarly employed U.S. workers, and that the wages offered to the foreign worker are at least equal to the prevailing wage rate in the area. The employer must also attest that there are no labor disputes that may arise in connection to the position.
