What is the PERM process?

The PERM process is a specific type of immigration application process, established by the United States Department of Labor (DOL) in 2005, that enables employers in Washington to sponsor foreign nationals for lawful permanent residency (green card) through employment. PERM stands for Program Electronic Review Management and it is an electronic filing system used to obtain labor certification from the Department of Labor on behalf of an employer. This labor certification is needed in order for the employer to sponsor a foreign worker for a U.S. green card. The PERM process involves the employer submitting an attestation to the DOL, which claims that the employer has conducted a good faith recruitment effort to find a qualified and willing U.S. worker for the job. After the DOL has received the documents, they review the application and will send the employer a Notice of Acceptance or Denial. Once the employer has been notified of acceptance, the employer can submit the foreign worker’s green card application to U.S. Citizenship and Immigration Services. The foreign worker must then provide certain medical and financial documents to complete their application. If everything is in order, the foreign worker will be approved for their green card and be granted the right to live and work in the United States.
