What is the E-2 visa?

The E-2 visa is a type of visa that allows foreign nationals to come to the United States to manage and direct a business in which they have invested a substantial amount of capital. This visa can also be used to develop and direct the operations of an enterprise in which the foreign national has a substantial ownership interest. In order to qualify for an E-2 visa, the foreign national must be a citizen of a treaty country and must have invested, or be in the process of investing, a substantial amount of capital in a U.S. enterprise. In California, the E-2 visa can be used by foreign nationals to open and operate a business. Foreign nationals seeking to pursue an E-2 visa must meet a number of requirements, including demonstrating that the business was established in accordance with U.S. laws and is engaged in activities that are substantially related to a treaty country. The foreign national seeking an E-2 visa must also demonstrate that the substantial investment was made in the U.S. business and that the funds invested were irrevocably committed to the enterprise. Additionally, the foreign national must demonstrate that the investment is substantial in relation to the total cost of purchasing or creating the business, and that it is sufficient to ensure the successful operation of the enterprise. In California, an E-2 visa may be used to enter and remain in the state for a maximum period of two years. However, the visa may be extended and the foreign national may remain in the United States for indefinite periods of time, as long as the foreign national continues to meet the requirements for the visa.
