What is a labor certification?

A labor certification is a document needed by the U.S. Department of Labor (DOL) to approve employment of a foreign worker in California. The labor certification process helps employers to ensure that foreign workers are not displacing qualified U.S. workers. The labor certification must show that there are no U.S. workers who are available, willing, and qualified to fill the position. The employer must file an application with all the relevant information, such as the employer’s identity, the job title, the wages being offered, the job description, and the availability of U.S. workers. The DOL will then evaluate the application and decide if the foreign worker can be employed. If approved, the employer will receive an approved labor certification. Some visa categories require labor certifications as part of the application process for foreign workers, including the Permanent Labor Certification Program (PERM) and the Temporary Labor Certification Program (H-1B). PERM is used for permanent visas, while H-1B is for temporary visas. Obtaining a labor certification is an important step in the process of bringing a foreign worker into the United States. The labor certification helps to ensure that the foreign worker does not displace qualified U.S. workers. It also helps employers to make sure that the wages and working conditions of the foreign worker are fair.
