What is a change of status?

A change of status is when an individual changes from one immigration status to another. In California, this can refer to someone moving from having no legal immigration status to a legal status (such as obtaining a visa or a green card). It can also refer to someone changing from one type of visa to another. For example, if someone with an F-1 Student Visa wants to change to an H-1B Visa for employment, this is considered a change of status. The process of changing one’s immigration status can be complicated and requires the filing of various forms and documents. It is important to note that someone seeking to change their status should not leave the US before their change of status is approved. Doing so could jeopardize the application process as well as the individual’s rights to remain in the US. If someone is granted a change of status, they are typically allowed to remain in the US. This is true even if their current visa or immigration status will expire before the new status is granted. However, it is important to understand that the change of status process may take several months or even years to complete. Additionally, changes of status must be approved before someone is able to work or adjust their status.
