What is the International Court of Justice Advisory Opinion?
The International Court of Justice (ICJ) Advisory Opinion is a legal opinion that is issued by the ICJ in response to a request from an authorized authority. According to their website, “The function of Advisory Opinion is to interpret conventions, treaties, and other international instruments, or to ascertain the legal relationship between the parties”. It is considered a binding opinion, so those parties involved in the legal dispute must adhere to the opinion. In the state of Florida, the ICJ Advisory Opinion can be requested by the state legislature or Governor. The legislature may be interested in seeking an opinion in the context of whether a state statute is in line with international law or not. In addition, the ICJ Advisory Opinion may be used to help resolve an international dispute amongst two or more states. The advisory opinion process is different from traditional legal cases in that it does not involve the parties to the dispute. Also, the ICJ will not decide the outcome of a dispute, but rather it will provide guidance to the parties on issues of international law. In the event that a dispute is not resolved by the opinion, the parties must turn to other forms of dispute resolution.
