What is the International Court of Justice Advisory Opinion?

The International Court of Justice (ICJ) Advisory Opinion is an opinion by the ICJ that is not legally binding, but is instead issued as a consultative tool to advise foreign governments and organizations on international law. The ICJ is the principal judicial body of the United Nations and its decisions are considered to be of major importance in international law. An advisory opinion of the ICJ can be requested by an organ of the United Nations, any other governmental organization, or a group of states. Typically, the opinion is meant to settle a dispute between states, such as territorial claims or payment of debt. The opinion is also issued to advise states on the broad questions of international law, such as the legality of a certain action or the interpretation of an international treaty. In response to a request for an advisory opinion, the ICJ will issue a report that discusses the legal issues or questions that it was asked to address. This report provides a comprehensive explanation of the legal issues and a thorough exploration of the applicable international law. The ICJ’s opinion cannot bind the parties to the dispute, but it can provide valuable guidance and insight into the legal issues. Given the significance of the ICJ and its advisory opinions, it is important for states and organizations to understand how they could be affected by an opinion. In New Jersey, as well as other states around the world, the ICJ Advisory Opinion is an important source of international law.
