What is the International Law of State Succession?

The International Law of State Succession is a term used to describe the laws and regulations established by the international community that set out how a new state or government should be formed when an existing state or government is dissolved, has its sovereignty taken away, or is divided in two. This law is important in international relations because it not only sets a framework for the resolution of disputes in the international arena, but also serves to ensure respect for the right of self-determination of peoples, and the right of states to the independence and sovereignty of their borders. In the United States of America, the International Law of State Succession is largely governed by the Vienna Convention on Succession of States in Respect of Treaties. This convention outlines the conditions under which the succession of a new state should take place, including requirements for the recognition of the new state by other states, and the transfer of rights and duties between the former and the successor states. Additionally, the International Law of State Succession also establishes guidelines for the division of existing states into two or more states, such as the dissolution of the Soviet Union in 1991. In this case, the relevant international law is the 1977 Declaration on Principles of International Law Concerning Friendly Relations and Co-operation among States in Accordance with the Charter of the United Nations. This agreement stipulates that the division of a state must take place based on the principles of respect for the wishes of the peoples involved and mutual agreement between the former and successor states.
