What is the International Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT)?
The International Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) is an international legal instrument adopted by the United Nations General Assembly in 1984. The purpose of the CAT is to prevent the practices of torture and cruel, inhuman and degrading treatment or punishment. The CAT defines torture as “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person” for a number of reasons, including “any reason based on discrimination of any kind”. The CAT also defines cruel, inhuman and degrading treatment or punishment as “any act which causes suffering or humiliation of an individual for a number of reasons”. The CAT prohibits the use of torture, cruel, inhuman and degrading treatment or punishment in all circumstances, including war and other armed conflicts. It also establishes an absolute obligation for States parties to investigate, prosecute and punish any person responsible for torture. The CAT imposes penalties on States parties if they fail to comply with its provisions, including the adoption of specific measures for the prevention of torture. In Washington, there are various federal, state and local laws that have been put in place to ensure compliance with the CAT, as well as the investigation and prosecution of any violations.
