What are the overtime laws?

In Tennessee, overtime laws require employers to pay their workers one and a half times their regular wage rate for all hours worked over 40 hours in a work week. There are some restrictions on overtime, such as that it cannot exceed 12 hours in a workday, and work cannot exceed 60 hours in a workweek. The overtime law in Tennessee applies to most employers, and those who are exempt include independent contractors, casual laborers, farm laborers, and those employed in an executive, administrative, or professional capacity. Employers are also exempt from paying overtime for any work that is considered “voluntary”, meaning that the employer has not asked the employee to work more than 40 hours. In addition, Tennessee labor law requires that employers provide employees with at least one day of rest per workweek, which is generally defined as Sunday. Employers are also prohibited from asking employees to work more than eight hours a day without providing additional time for rest. Employers are also prohibited from asking their employees to work more than 10 consecutive days without providing them with at least one day of rest. Any employee who feels that their employer has violated their rights under the overtime laws in Tennessee may file a complaint with the Tennessee Labor and Workforce Development Department. If the employee is found to be correct in their claims, the employer may be liable for unpaid wages, fines, and other damages.
