What are the laws concerning wage and hour disputes?
In Minnesota, wage and hour law disputes are regulated by the Minnesota Fair Labor Standards Act. This act sets the guidelines for minimum wages, overtime pay for employees and breaks. The minimum wage is currently $10.08 for large employers and $8.21 for small employers. Employees must also be paid time and a half for any hours worked over 48 hours in a seven-day period. Employees are also entitled to one and a half times their regular rate of pay for any work performed on a designated holiday. In addition, the Minnesota Department of Labor and Industry requires employers to provide breaks for employees during their shift. Breaks of at least ten minutes must be provided to any employee working five or more consecutive hours. Employees must also receive a 30-minute meal break if they work more than eight consecutive hours. For disputes concerning wages and hours, employees have the right to file a complaint with the Minnesota Department of Labor and Industry. Employees may also pursue claims in a court of law to recover back wages and other compensation they feel they are owed. Complaints must be filed within two years of the last alleged violation of the Minnesota Fair Labor Standards Act.
