What is the Indian Child Protection and Family Violence Prevention Act?

The Indian Child Protection and Family Violence Prevention Act (ICPFVP) is a law in New Jersey that provides protections for Native American children and families who have experienced or are at risk of domestic violence, child abuse, and neglect. The Act was passed in 2018 and is designed to create an environment of safety for Native American children and families, hopefully increasing the probability of permanent family reunification. In response to the issues associated with sexual and domestic violence in Native American communities, the ICPFVP outlines a set of new protections aimed to ensure the safety of children and victims, and to bolster support services for Native American families and victims. This includes mandating the collection of data on sexual and domestic violence in Native American communities, and the sharing of information between state agencies and tribes. Also, the ICPFVP requires that tribal courts have the ability to enforce protective orders related to domestic violence. The ICPFVP also sets new standards for service providers and community organizations, such as providing more culturally-competent mental and physical health services, and establishing a native-controlled Prevention and Response Agency to connect indigenous victims to resources. The ICPFVP also expands the roles of tribal police departments, grants more funding for tribal courts, and encourages tribally-based juvenile probation programs. The ICPFVP is part of a larger effort to provide support for Native American children and families, as well as increasing awareness and accountability on the issue of violence in Native communities. With this law, Native American families will have better protection from domestic and sexual violence, allowing them to have a safe and stable future.
