What is the Social Security Disability appeals process?
The Social Security Disability (SSD) appeals process in Washington begins when an individual is denied their benefits. The individual has the right to appeal the decision by submitting a Request For Reconsideration to the Social Security Administration (SSA). During the Request For Reconsideration phase, the SSA will review all medical evidence and any new information that has been submitted, and determine if they still believe the individual is not disabled and therefore not eligible for benefits. If the Request For Reconsideration is not successful, the individual may then appeal the decision by submitting a Request for a Hearing. During the hearing, the individual will have the opportunity to have their case heard by an Administrative Law Judge (ALJ). The ALJ will review all evidence and testimony, and make a decision as to whether or not the individual is eligible for SSD benefits. If the ALJ’s decision is unfavorable, then an individual may appeal their case to the Appeals Council. The Appeals Council will review all evidence as presented to the ALJ and make a decision as to whether or not the individual is eligible for SSD benefits. If the Appeals Council’s decision is unfavorable, then the individual may file for a review in federal court. The appeals process can be lengthy, so it’s important for individuals to do their research and get informed about the rules and regulations of SSD in Washington before appealing a decision. It is also important to have a lawyer to help file the appropriate paperwork and represent the individual through the entire process.
