What are the different levels of the Social Security Disability appeals process?
The Social Security Disability appeals process in California is a multi-leveled system. This means that if an individual’s initial application for disability benefits is denied, they are entitled to appeal the decision. The first level is called ‘reconsideration’. During this stage, a different reviewer will assess the individual’s case and decide if the initial decision should be overturned. If the reconsideration decision is still negative, the individual is then eligible to proceed to the next level. The second level is called a ‘hearing’. This includes a review by an administrative law judge who will consider all the evidence and testimony presented. This can be done in person or over the phone. If this decision is still unfavorable, the individual still has one more option. The third and final level of the appeals process is an appeal to the Appeals Council. The Appeals Council will review the hearing decision and determine whether the administrative law judge made any errors in their judgment or interpretation of the evidence. If the Appeals Council finds that errors were made, they can overturn the decision and order a re-hearing or request that a new decision be made. No matter which level of the appeals process the individual goes through, they are entitled to an explanation of why their benefits are being denied. This can be a complicated process, so it is important for individuals to seek legal advice before navigating it.
