What are the rules for paying overtime?

In Mississippi, overtime rules are established by the Fair Labor Standards Act (FLSA). The FLSA is a federal law that sets regulations for wages and hours, as well as other labor standards. In general, employers must pay their employees the Federal minimum wage rate and overtime pay for all hours worked over 40 in a work week. The overtime rate is 1.5 times the employee’s regular rate. Under the FLSA, an employer may not average hours over two or more weeks to avoid paying overtime. In Mississippi, an employee must also receive overtime compensation when they work more than eight hours in a single workday or when they work more than five consecutive days in a single workweek. Additionally, employers must pay employees overtime when they work seven consecutive days in a workweek. It is important to note that not all workers are subject to overtime laws. There are certain types of workers that are exempt from overtime regulations, such as certain types of salaried employees. In Mississippi, employers must pay nonexempt employees at least minimum wage for all hours worked and overtime compensation for all hours over 40 hours worked in a workweek. If an employer fails to do so, they can be subjected to fines and penalties.
