What is the difference between overtime hours and double time?

Overtime hours and double time are terms used when referring to Wage and Hour Law in Virginia. It is important to understand the difference between the two in order to ensure compliance with the law. Overtime is the amount of time worked above the normal 8-hour work day. Overtime hours in Virginia are those hours worked in excess of 40 hours per week. For any hours worked above the 40-hour workweek, the employee must be paid 1.5 times their regular hourly rate. Double time is when the employee receives twice their regular hourly rate for any hours worked. Double time is usually something reserved for special occasions such as holidays and overtime could qualify for double time in certain cases. There is a Virginia statute that states if an employee works 6 days in a row, they must be paid double time for any hours worked on that 6th day. It is important to keep track of each employee’s hours and to pay them correctly according to the law. This ensures that both the employer and employee are in legal compliance with Wage and Hour Law in Virginia.
