Are employers allowed to reduce an employee’s wages while they are on vacation?
In Virginia, employers are not allowed to reduce the wages of their employees while they are on vacation. According to the Virginia Minimum Wage Act, employers must pay their employees their regular rate of pay, even if the employee is on vacation. If an employee works part of their vacation, then their employer may pay them for the amount of hours worked at their regular wage rate. However, if an employee does not work while on vacation, their employer must still pay them their regular wages. Additionally, employers must also adhere to the federal Fair Labor Standards Act (FLSA) when it comes to wages and vacation, which establishes a nationwide minimum wage and sets overtime pay standards. According to the FLSA, employers must pay employees their full wages while on vacation, unless other arrangements have been made between the employer and employee. In sum, employers in the state of Virginia are prohibited from reducing the wages of their employees while they are on vacation. Both the Virginia Minimum Wage Act and the FLSA require employers to pay their employees the same rate they normally receive while on vacation.
