What is the difference between compensatory time and overtime pay?
Compensatory time and overtime pay are two possible forms of wages that an employer may choose to provide to its employees. The major difference between the two is that overtime pay is paid out in cash, while compensatory time is time off. In Virginia, overtime is defined as any work performed in excess of 40 hours per week. This means that if an employee works over 40 hours, they must be compensated with overtime pay. This overtime pay is typically paid at a rate of 1.5 times the employee’s regular rate of pay. Alternatively, some employers choose to provide compensatory time instead of overtime pay. This means that the employee will receive time off from work, rather than extra pay. They will still receive their regular rate of pay for the hours worked, but the extra hours will be considered as time off, usually in the form of vacation or sick days. These are the main differences between compensatory time and overtime pay. However, employers must still adhere to the provisions of the Fair Labor Standards Act, regardless of which method they choose to use.
